3. JOHN C. READ. RESTORATION HEARING. Commission review of a violation (Notice to Comply #96-04) and the extent of restoration required for the unauthorized expansion of an existing commercial pier situated along the James River in Isle of Wight County.

4. SEA HUNT, INC., #97-0163, requests authorization for an exclusive permit to conduct underwater recovery operations within two (2), six-square mile areas off Assateague Island in the Atlantic Ocean to recover potential historic property.

5. J.P.M., INC., #96-1342, requests authorization to fill 10,750 square feet of tidal wetlands for an access road, construct a 120-foot long bridge over Heartquake Creek with an associated dock, and install culverts and fill for a road crossing of Plymouth Creek at their property in King and Queen County. Wetland and Subaqueous permits are required.

6. CHARLES P. DICKERMAN, #96-1782, requests authorization to dredge for fill approximately 100 cubic yards of State-owned subaqueous land adjacent to his property situated along the James River in Charles City County.

7. CITY OF NEWPORT NEWS, #96-1686, requests authorization to install a 440-foot long bridge, associated abutments and riprap across Lucas Creek in the Denbigh Shores subdivision. The project is protested by several nearby property owners.

8. PATUXENT WILDLIFE RESEARCH CENTER, #97-0285, requests authorization to experimentally place approximately 4.5 cubic yards of shell material on State-owned marsh in an effort to enhance colonial waterbird nesting sites on Egging Marsh in Hog Island Bay in Northampton Country. A wetlands permit is required.

9. TARMAC AMERICA, INC., #97-0022, requests authorization to construct a denil fish passage to allow migratory fish to pass between a tidal portion of Massaponax Creek and Ruffin's Pond, a man-made impoundment in Spotsylvania County. The construction will require the installation of 70 linear feet of quarry stone riprap, revetment bank stabilization and the placement of 18 cubic yards of associated fill material which will encroach on 494 square feet of non-vegetated intertidal wetlands. A wetlands permit is required.

2A. COLUMBIA GAS TRANSMISSION CORP., #96-1251, requests authorization to construct 7.3 miles of gas transmission pipeline involving two (2) perennial stream crossings at Second Swamp and Warwick Swamp in Prince George and Sussex Counties respectively. Recommend a royalty in the amount of $67.00 for the crossing of 67 linear feet of subaqueous land at a rate of $1.00 per linear foot.

2B. DEPARTMENT OF MINES, MINERALS AND ENERGY, #96-1508, requests authorization to install two concrete, clearspan bridges, two K-dam structures and one boulder complex and to riprap approximately 460 linear feet of streambank in conjunction with the Indian Creek Sedimentation Project, Phase I, in Wise County.

2C. ARMY CORPS OF ENGINEERS, #94-1284, requests authorization to place approximately 7,000 cubic yards of sandy dredged material obtained from the Narrows channel along 1,450 linear feet of the First Landing Seashore State Park shoreline in Virginia Beach.

2D. CITY OF LYNCHBURG, #97-0063, requests authorization to cross a total of 122 linear feet of Ivy Creek at six sites with a submerged sewer line in conjunction with the CSO Interceptor Project near Peaks View Park in the City of Lynchburg. Recommend approval with our standard instream construction conditions.

2E. TARMAC AMERICA, INC., #97-0045, requests authorization to install nine (9) 12-pile mooring dolphins adjacent to their property situated along the Western Branch of the Elizabeth River in the City of Portsmouth. Recommend a royalty in the amount of $43.20 for the encroachment of the dolphin structures at $0.30 per square foot.

2F. GREENWOOD IRONWORKS, #95-1161, requests authorization to modify an existing permit to allow for instream work to continue during the March 1 - June 30 time-of-year restriction. The overall project involves a rehabilitation of the Harvell Power Station and the construction of a fish ladder at the Harvell Dam situated along the Appomattox River in the City of Petersburg.
