Public Notice:  Proposed Regulations, April 2016

The Virginia Marine Resources Commission invites public comment on the establishment of amendments to regulations, as proposed below. By April 11, 2016, the proposed draft regulations may be viewed at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia.

In accordance with Section 28.2-209 of the Code of Virginia, a public hearing on the proposed regulations will be held no earlier than 12:00 noon, on Tuesday, April 26, 2016, at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. Public comments on the proposals should be provided to Robert L. O�Reilly, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia 23607, by 12:00 p.m., Monday, April 25, 2016.

I. Chapter 4 VAC 20-490-10 et seq., �Pertaining to Sharks�

The Commission proposes to amend Chapter 4 VAC 20-490-10 et seq., "Pertaining to Sharks," that would establish the May 1 through April 30 commercial spiny dogfish harvest quota.

The purpose of this amendment is to comply with the ASMFC�s allocation of 4,356,944 pounds of commercial spiny dogfish quota to Virginia.

II. Chapter 4 VAC 20-910-10 et seq., �Pertaining to Scup (Porgy)�

The Commission proposes to amend Chapter 4 VAC 20-910-10 et seq., �Pertaining to Scup (Porgy)� that would establish the May 1 through October 31 commercial harvest quota for scup.

The purpose of this amendment is to comply with the ASMFC�s allocation of 13,154 pounds of the scup summer period quota to Virginia.

III. Chapter 4 VAC 20-900-10 et seq., �Pertaining to Horseshoe Crabs�

The Commission proposes to amend Chapter 4 VAC 20-900-10 et seq., �Pertaining to Horseshoe Crabs�, to modify the May 1 through June 7 prohibition that makes it unlawful for any individual to harvest horseshoe crabs within 1,000 feet in any direction of mean low water, for horseshoe crabs harvested by pound net gear.

The purpose of this amendment is to reduce excess handling of spawning horseshoe crabs and provide equitable horseshoe crab harvest opportunities for traditional fixed fishing pound net gear.
