The Virginia Marine Resources Commission invites public comment on the establishment of amendments to the regulations, as proposed below. By May 13, 2019 the proposed draft regulation may be viewed at the Virginia Marine Resources Commission, 380 Fenwick Road, Bldg. 96, Fort Monroe, Virginia.
In accordance with Section 28.2-103 and 28.2-209 of the Code of Virginia, a public hearing on the proposed amendment to this regulation will be held beginning at 9:30 a.m., on Tuesday, May 28, 2019, at the Virginia Marine Resources Commission, 380 Fenwick Road, Bldg. 96, Fort Monroe, Virginia. I. CHAPTER 4 VAC 20-1340-10 ET SEQ., �FAST-TRACK PERMITTING PROGRAM FOR DISPOSAL OF DREDGED MATERIAL�
The Commission proposes to adopt Chapter 4 VAC 20-1340-10 et seq., �Fast-Track Permitting Program for Disposal of Dredged Material� that would establish the necessary application requirements and review procedures for fast-track permitting of dredging and dredged material disposal sites involving state-owned submerged lands. Fast-track consideration of permit applications for dredging projects and associated dredge material disposal sites involving state-owned submerged lands shall be provided to local governments in Tidewater Virginia, when shoreline or open water placement of dredge material is preferable for habitat creation, development of living shoreline features or to provide for coastal resiliency.
The regulation is required pursuant to Acts of Assembly 2018, Chapter 449.
