Public Notice: General Wetlands Permit for Emergency Situations

NOTICE 

The Virginia Marine Resources Commission invites public comment on a proposed regulation, 4 VAC 20-345-10 et seq., entitled "General Wetlands Permit for Emergency Situations."

Purpose and Summary of Proposed Regulation:

Purpose: The purpose of the proposed regulation is to develop an expedited process for the issuance of general wetlands permits to be used by applicants during emergency situations in which a determination has been made that there is a threat to public or private property, or to the health and safety of the public.

Summary: The proposed regulation applies in those localities which have elected to adopt and locally administer the provisions of the model wetlands zoning ordinance contained in Chapter 13 of Title 28.2 of the Code of Virginia (§§28.2- 1300 et.seq.). It authorizes the Chairman of a local wetland board to issue a general wetlands permit upon a finding that an emergency situation exists and that the anticipated impact to adjoining property owners and nonvegetated tidal wetlands are minimal. The general permit is valid for a maximum period of 90 days from the date of issuance, and the Commissioner of Marine Resources shall review all decisions of the local wetland board.

In accordance with §§28.2-1307.B and 28.2-103 of the Code of Virginia, a public hearing on the adoption of the proposed regulation will be held on Tuesday, February 24, 1998 beginning at 9:00 a.m. at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. Written comments on the proposed regulation should be mailed to Robert W. Grabb, VMRC Habitat Management Division, P. O. Box 756, Newport News, VA 23607.
