Publice Notice: Pertaining to Landing Licenses

The Virginia Marine Resources Commission invites public comment on the proposed amendments to the regulations listed below.

In accordance with §28.2-209 of the Code of Virginia, a public hearing on the proposed amendments will be held at 12:00 Noon on Tuesday, February 24, at the Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia.  Written comments on the proposals should be mailed to Jack Travelstead, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia  23607.  Copies of the proposed amendments may be reviewed at the Commission Monday through Friday, 8:15 a.m. to 5:00 p.m. and may be obtained by calling the Commission at (757) 247-2248.

1.  Regulation 4 VAC 20-920-10 et seq., "Pertaining to Landing Licenses."

The Commission proposes to modify the requirements for the transfer of summer flounder endorsement licenses from one vessel to another by establishing a baseline of vessel length and gross transfer for each vessel licensed for the flounder fishery as of February 24, 2004.  Thereafter, any vessel receiving a summer flounder endorsement license by transfer must be within 10 percent of the length and gross tonnage of the baseline vessel.

The purpose of the proposed amendment is to align the regulation more closely to the requirement of federal statutes governing the transfer of federal flounder permits.

2.  Regulation 4 VAC 20-720-10 et seq., "Pertaining to Restrictions on Oyster Harvest."

The Commission proposes to open public oyster grounds to the harvesting of oysters by hand scrape in the area of Pocomoke Sound northeast of the Pocomoke-Tangier Sound Management Area for the month of March.  The Commission also proposes to extend the oyster dredging season in the Pocomoke-Tangier Sound Management Area through March 31, 2004.
