Publice Notice: Proposed Amendments to Regulations, January 2007

NOTICE

The Virginia Marine Resources Commission invites public comment on the proposed amendments to the regulations listed below.

In accordance with §28.2-209 of the Code of Virginia, a public hearing on the proposed amendments will be held at 12:00 Noon on Tuesday, January 23, 2007 at the Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia.  Written comments on the proposals should be mailed to Jack Travelstead, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia  23607, by 5:00 p.m., Monday, January 22, 2007.  Copies of the proposed amendments may be reviewed at the Commission Monday through Friday, 8:15 a.m. to 5:00 p.m. and may be obtained by calling the Commission at (757) 247-2248.

Regulation 4 VAC 20-510-10 et seq., “Pertaining to Amberjack and Cobia”

The Commission proposes to amend this regulation to allow for the culture of cobia by permitted aquaculture facilities.  The amendments:

1)    Establish a cobia aquaculture permit and application process;
2)    Authorize permittees to possess and sell cobia in sizes and quantities that would,
         otherwise, violate the provisions of the current regulation;
3)      Require permitted facilities to be open for inspection by the Marine Resources
         Commission for the purposes of determining compliance with this regulation;
4)      Prohibit the transfer of an aquaculture permit
5)      Require cobia from an aquaculture facility to be packaged prior to sale with a printed label indicating the product is of aquaculture origin;
6)      Allow for the sale in Virginia of aquaculture cobia from another state, provided the product is labeled as an aquaculture product; and,
7)    Prohibit the release of any aquaculture cobia into Virginia waters without the written permission of the Commissioner.

Regulation 4 VAC 20-70-10 et seq., “Pertaining to the Harvesting of Clams”

The Commission proposes to amend this regulation to allow for the harvest, on the Seaside of the Eastern Shore, of more than 250 clams by any boat licensed to take blue crabs with a dredge, when that vessel is also licensed to take clams with a dredge.
