Public Notice: Pertaining to Eastern Shore Bayside Management Areas

The Virginia Marine Resources Commission invites public comment on proposed amendments to Regulation 4 VAC 20-480-10 et seq., "Pertaining to Eastern Shore Bayside Management Areas." A summary of the proposed amendments is presented below.

In accordance with Section 28.2-209 of the Code of Virginia, a public hearing on the adoption of the proposed regulation will be held at 12:00 noon on Tuesday, August 26, 1997 at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. Written comments on these proposals should be mailed to Jack Travelstead, VMRC Fisheries Management Division, P. O. Box 756, Newport News, VA 23607. A copy of the proposed regulation and charts depicting the areas described below may be reviewed at the Commission from Monday through Friday, 8:15 a.m. to 5:00 p.m. Persons interested in obtaining a copy of the proposed regulation and charts may call the Commission at (757) 247-2248.

SUMMARY OF THE PROPOSED AMENDMENTS:

The Commission proposes to amend Regulation 4 VAC 20-480-10 et seq. such that during the period June 1 through October 31, it shall be unlawful for any person to place, set, or fish any gill net or fixed fishing device in the management areas described below:

Nandua Creek

Beginning at daymarker R4 at the entrance to Nandua Creek and running thence in a northeasterly direction in a straight line through daymarker G9 and continuing to the mean low water mark on the northeast side of Nandua Creek (Hacksneck); thence following the mean low water line in a southerly and easterly direction to the southernmost extremity of the point of land on the northwest side of the mouth of Back Creek; thence running in a southeasterly direction across Back Creek to the mean low water line at the northwest extremity of the point of land on the southeast side of the mouth of Back Creek; thence running southwardly along the mean low water line (approximately 400 yards) to the point at which a line drawn due west would intersect with daymarker G13; thence running due west to daymarker G13; thence running in a westerly direction to the northernmost extremity of Milby's Point; thence running in a southwesterly direction (approximately 700 yards) to the point at which a line drawn in a due southeast direction from daymarker R4 would intersect the mean low water line on the western shore of Milby's Point; thence running due northwest to the point of beginning at daymarker R4.

Craddock Creek

Beginning at the southern extremity of Sandy Point at the entrance to Back Creek; thence running due west for a distance of 500 yards; thence running due southwest to the intersection with Latitude 37o 35' N; thence due southeast to the low water mark of the Bay shore; thence following the low water mark in a northerly and easterly direction across the mouth of Bull's Cove (not into Bull's Cove) and continuing into Craddock Creek to the northern-most point of land on the south side of Craddock Creek; thence running northwesterly to the western-most point of the peninsula on the south side of Back Creek; thence running northwesterly to the point of beginning at Sandy Point.

Occohannock Creek

Beginning at daymarker G5 at the entrance to Occohannock Creek; thence running due southeast to the low water mark of the Bay shore; thence running along the low water mark in a northerly and then easterly and southeasterly direction around Sparrow Point and into Killmon's Cove to the point at which the low water line turns back to the south; thence in a northerly direction to the point of land at the southwestern extremity of Old Neck; thence in a northerly direction to flashing marker 9 at the entrance to Occohannock Creek; thence continuing in a northerly direction to the southernmost extremity of Powell's Bluff; thence following the low water line in a westerly and northerly direction to a point which if measured in a straight line would be a distance of 500 yards from the southernmost extremity of Powell's Bluff; thence running due west 300 yards; thence turning and running back in a southerly direction to the point of beginning at Marker G5.

Nassawadox Creek

Beginning at the mean low water line at Shooting Point; thence running due west a distance of 250 yards; thence running in a northwesterly direction to the point 250 yards due west of the mean low water line at Nassawadox Point; thence running due east to Nassawadox Point; thence running northeasterly across the mouth of the cove on the north side of Nassawadox Creek (sometimes referred to as Bosman's gut or cove) to the low water mark due south of the southwestern extremity of the high point of land on the east side of said cove; thence running southeasterly to a point 200 yards due east of the northernmost point of Horse Island; thence running due south to the low water line on the south shore of Nassawadox Creek; thence following said low water line in a westerly direction to the point of beginning.

Hungars Creek, Mattawoman Creek, the Gulf, Smith Beach

Commencing at F1.G Marker #1 at the entrance of Hungars and Mattawoman Creeks; thence running southwardly in a straight line to a point 200 yards due west of the low water mark opposite the VOR-TAC station tower at the south end of Wilkins Beach; thence running due east to the low water line of the Chesapeake Bay; thence following the low water line of Chesapeake Bay northwardly to the point in the mouth of the Gulf at which the shoreline turns to the south; thence due north across the mouth of the Gulf to the low water line on the north side of the Gulf; thence continuing along the low water line in a northerly direction to the point at which the shoreline turns to the south and east; thence continuing along the low water line following the shoreline of Mattawoman Creek and across (but not into) the mouth of Barlow Creek; thence continuing along the low water line of Mattawoman Creek in a northerly direction for a distance of approximately 300 yards to the point at which the creek shore turns northeastwardly; thence following a straight line across Mattawoman Creek in a northeasterly direction to Taylor Wharf point; thence following the low water line northerly and northwesterly to a point due east of F1.R #6; thence running westerly across Hungars Creek to the southernmost extremity of Great Neck; thence following the low water line northerly to a point which if measured in a straight line would be 2,800 yards from the southern-most extremity of Great Neck; thence running due west into Chesapeake Bay for a distance of 750 yards; thence running southerly in a straight line to the point of beginning at F1.G #1.

Cherrystone Creek

Beginning at a point 200 yards due east northeast of the brick structure on Sandy Island at the mouth of Cherrystone Creek; thence running due west southwest a distance of 200 yards to the brick structure on Sandy Island; thence running due west for a distance of 750 yards; thence running in a northerly direction for a distance of 2,500 yards to a point 750 yards due west of the mean low water line of the Bay shore; thence running due east for a distance of 750 yards to the mean low water line; thence running in a southerly direction in a straight line to the point of beginning.

Old Plantation

Beginning at a point 1,000 yards due south of the inshore range light (A) on the Bay shore south of Cape Charles harbor, said point being approximately 400 yards due west of the mean low water line of the Bay shore; thence running due south a distance of 2,500 yards to a point approximately 800 yards west of the north side of the entrance to Elliot's Creek; thence running easterly 800 yards, more or less, to the point at which the mean low water line on the north side of Elliot's Creek intersects the mean low water line of the Bay; thence following the mean low water line of the Bay shore in a northerly direction to the entrance to Old Plantation Creek; thence following the mean low water line into and along the south shore of Old Planation Creek to a point on the west side of the mouth of a cove; thence running in a northeasterly direction across the mouth of the cove to the point of land on the east side of the mouth of said cove; thence running in a northerly direction across Old Plantation Creek to the northeasternmost point of the marsh (or island) situated on the north side of the creek; thence in a more northwesterly direction to the nearest point of land on the mainland; thence following the mean low water line of the north side of Old Plantation Creek in a general westerly direction to the low water line of the Bay shore; thence following the low water line of the Bay in a westerly and northerly direction to a point on the Bay shore due east of the point of beginning; thence running due west a distance of 400 yards, more or less, to the point of beginning.
