1.     REGULATION 4 VAC 20-1020-10 ET SEQ.

The proposed regulation implements the provisions of House Bill 993, adopted during the 1998 Session of the General Assembly. House Bill 993 amended §28.2-204.1 of the Code of Virginia and authorizes the Commission to issue gear licenses or permits to fish, which are currently restricted or limited, to any person who has resided for at least five years on an island in the Commonwealth that is at least three miles from the mainland.

Under current regulations, licenses and permits for crab pots, peeler pots, crab dredges, pound nets, black drum, striped bass, and commercial hook-and-line are capped and are issued only under special circumstances. The Commercial Fisherman Registration License is available to any applicant after a two year waiting period.

The Commission proposes by Regulation 4 VAC 20-1020-10 et seq. to make the above mentioned licenses and permits to fish available to any person who has resided on Tangier Island for at least five years.
