Publice Notice: MRC establishes Hand Scrape area 2002

The Virginia Marine Resources Commission invites public comment on emergency amendments to Regulation 4 VAC 20-720-10, "Pertaining to Restrictions the regulation listed below. The emergency amendments were adopted by the Commission, under the authority of §28.2-210 of the Code of Virginia.

In accordance with §28.2-209 of the Code of Virginia, a public hearing on the adoption of the proposed emergency amendments as part of the final regulation will be held at 12:00 noon on Tuesday, December 17, 2002, at the Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. Written comments on the proposals should be mailed to: Jack Travelstead, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia 23607. A copy of the proposed amendments may be reviewed at the Commission during Monday through Friday, 8:15 a.m. to 5:00 p.m. Persons interested in obtaining a copy of the proposed regulations may call the Commission offices at (757) 247-2248.

PROPOSED AMENDMENTS:

4VAC 20-720-40. OPEN SEASONS AND AREAS: The Commission established the following hand scrape area is established, with an open season, from November 27, 2002 through January 15, 2003.

"Temples Bay Hand Scrape Area" means that area in the Rappahannock River, west of the Rt. 3 Bridge and south of a line drawn from the center of the Rt. 3 bridge (Norris Bridge) upriver to Towles Pt. continuing the line upriver to Red Buoy 8; thence across to the south side of the river to Long Pt., thence back to the Rt. 3 bridge (Norris Bridge) along the southern shoreline.

4VAC 20-720-70. GEAR RESTRICTIONS: The allowable maximum weight of a standard dredge is increased from 100 pounds to 150 pounds, for harvesting oysters from the Deep Rock Dredge Area in the Pocomoke and Tangier Sounds Management Area in Tangier Sound, from Tangier Light north to the Maryland-Virginia Line and in Pocomoke Sound, northeast from a line from Beach Island Light to the house on the Great Fox Island, except for the designated hand tong areas.

The purpose of these amendments is to promote efficiency in utilization of this resource.
